Course Description
This course delves into the intricate jurisdictional issues that arise in industrial arbitration practice. It defines and explores the various jurisdictional challenges and their impact on the practice of industrial arbitration. The course covers key topics such as governing law, the jurisdiction of arbitral tribunals, venue and seat of arbitration, arbitrator’s jurisdiction, conflict of laws, international arbitration conventions, arbitration agreements, subject matter jurisdiction, personal jurisdiction, territorial jurisdiction, enforcement of arbitral awards, arbitral procedure, confidentiality and privacy, immunity and privileges, and emergency arbitration. Additionally, the course examines how these jurisdictional issues distinguish industrial arbitration from other forms of arbitration and discusses the influence of Industry 4.0 technologies on the development of industrial arbitration jurisprudence.
